Introduction

This Supplier Privacy Policy describes how TourVigator ("TourVigator", "we", "us" or "our") collects, uses, stores, discloses and otherwise processes Personal Data relating to activity providers, tour operators, guides, experience providers, transport providers, accommodation providers and other businesses or individuals offering travel-related services through the TourVigator platform (collectively, "Suppliers" or "you").

"Personal Data" means information relating to an identified or identifiable natural person, including information that you provide to us when creating or managing a Supplier account, submitting business or verification documents, communicating with us, receiving payments, managing bookings, or using the TourVigator platform.

This Privacy Policy applies to Suppliers regardless of where they are established or where their services are offered, subject to the data protection and privacy laws applicable to the relevant processing activity and jurisdiction.

This privacy policy has been drafted, and shall be construed, in the English language. Any translation of the privacy policy is provided for convenience only. In the event of any inconsistency between the English language version and a translated version, the English language version shall prevail to the extent permitted by applicable law.

Controller Details

The entity responsible for determining the purposes and means of processing Personal Data through the TourVigator platform will depend on the particular processing activity and applicable law. For processing carried out by TourVigator in connection with the Supplier platform, the relevant TourVigator entity may act as a data controller or equivalent responsible entity.

Where applicable, additional information about the relevant data controller, representative, processor, or privacy contact may be provided at the time Personal Data is collected or in a separate privacy notice.

Data Processing Activities

The Personal Data TourVigator collects from or about Suppliers depends on the Supplier's relationship with TourVigator, the services offered, the jurisdiction involved, the features used, and the requirements applicable to the relevant transaction or business relationship.

We may process Personal Data to create and administer Supplier accounts, verify Supplier identity and business information, publish and manage listings, facilitate bookings and payments, provide customer and Supplier support, prevent fraud and misuse, communicate important service information, improve our platform, comply with legal obligations, and protect the rights and security of TourVigator, Suppliers, Customers and other users.

Registration and Account Creation

TourVigator may collect information during Supplier registration and account management that may contain Personal Data, including:

• Contact information: name, business email address, telephone number, business address and other contact details
• Business information: business or company name, legal structure, registration details, operating address, ownership information, management information and relevant business documentation
• Tax and financial information: tax identification information, VAT or equivalent registration details, bank account information, payout information and other financial information required for legitimate business and payment purposes
• Service information: information about activities, tours, transportation, accommodation or other services offered through the platform
• Account information: login credentials, account preferences, verification status and records relating to the Supplier relationship

TourVigator uses this information to establish and manage the Supplier relationship, provide platform services, process payments and payouts, perform verification, prevent fraud, communicate with Suppliers, and comply with applicable legal, tax, financial and regulatory obligations.

Identity and Business Verification

To protect the integrity of the marketplace and Customers, TourVigator may require Suppliers to complete identity, ownership, business, licensing or other verification procedures. Depending on the Supplier, jurisdiction and service offered, information may include:

• Full name, address, date of birth and contact information
• Government-issued identification or equivalent identity documentation
• Business registration or incorporation documents
• Tourism, professional, operating or activity licenses and permits
• Tax registration or equivalent tax information
• Insurance documentation
• Ownership, director, beneficial-owner or authorised-representative information
• Photographs, selfies or other information where reasonably necessary for identity verification

The information requested will depend on the Supplier's jurisdiction, business type, services offered and applicable legal or platform requirements.

Messaging and Communication via the Platform

TourVigator may provide Suppliers with tools to communicate with Customers before, during or after a booking. Communications transmitted through the TourVigator platform may be stored, processed or reviewed where reasonably necessary to provide the service, support bookings, resolve disputes, prevent fraud or abuse, enforce platform rules, improve security, or comply with applicable law.

Suppliers should avoid including unnecessary sensitive Personal Data in communications and should only use Customer information for legitimate purposes connected with the relevant booking or service.

Supplier Support Services

TourVigator may collect Personal Data when providing Supplier support through email, support tickets, telephone, messaging applications, online forms or other communication channels. This may include information voluntarily provided by the Supplier, information concerning a booking or account, technical information, and information required to investigate and resolve a support request.

Support communications may be recorded or retained where permitted by applicable law and reasonably necessary for quality assurance, security, dispute resolution, training, compliance or business recordkeeping.

Payment Processing and Payouts

To facilitate payments, refunds, commissions and Supplier payouts, TourVigator may process or share relevant financial and transaction information with payment service providers, financial institutions, payout providers, fraud-prevention providers and other service providers involved in processing the relevant transaction.

The payment or payout provider used may vary depending on the Supplier's location, Customer location, payment method, currency, transaction requirements, availability and applicable law.

Where payment providers process Personal Data independently as their own controller or equivalent entity, their own privacy terms may also apply.

Marketing and Communications

TourVigator may use Supplier Personal Data to communicate important information about the platform, Supplier account, bookings, security, policy updates, product changes, service announcements, educational materials, surveys and, where permitted by applicable law, marketing communications.

Where consent is required for a particular marketing activity, TourVigator will seek the required consent. Where applicable law permits another lawful basis, communications may be sent on that basis.

Suppliers may unsubscribe from non-essential marketing communications using the available unsubscribe mechanism or by contacting TourVigator. Operational and legally required communications may continue where necessary.

Recipients of Personal Data

Personal Data may be disclosed to or accessed by third parties where reasonably necessary for the purposes described in this Privacy Policy, including:

• Service Providers and Technology Partners: hosting providers, cloud infrastructure providers, software providers, communication services, analytics providers, security providers and other technology partners supporting the operation of the platform.
• Payment and Financial Service Providers: payment processors, banks, payout providers, fraud-prevention services and other financial service providers required to process transactions or payouts.
• Customers: limited Supplier information may be shared with Customers where reasonably necessary to facilitate a booking, provide the purchased service, communicate about an activity or provide customer support.
• Business Partners and Distribution Channels: where a Supplier listing or booking is distributed through an authorised integration, affiliate, connectivity partner or other marketplace relationship, relevant information may be shared as necessary to complete or support the transaction.
• Professional Advisers: lawyers, accountants, auditors, insurers and other professional advisers where access is reasonably necessary for legitimate business or legal purposes.
• Authorities and Law Enforcement: courts, regulators, government authorities, law enforcement agencies or other authorised bodies where disclosure is required or permitted by applicable law or reasonably necessary to protect rights, safety or security.

We do not sell Supplier Personal Data as a standalone commercial product. Any disclosure will be subject to applicable law and the purpose for which the information is processed.

International Data Transfers

Because TourVigator operates a marketplace that may connect Suppliers and Customers across different countries, Personal Data may be accessed, stored or processed in countries other than the country in which the Supplier is located.

Where applicable law imposes requirements for international transfers of Personal Data, TourVigator will take reasonable steps to use an appropriate lawful transfer mechanism or other safeguard required by that law.

Data Security

TourVigator uses reasonable technical and organisational measures designed to protect Personal Data against unauthorised access, loss, misuse, alteration, disclosure or destruction.

However, no internet transmission, information system or storage method can be guaranteed to be completely secure. Suppliers are responsible for maintaining the confidentiality of their account credentials and for notifying TourVigator promptly if they suspect unauthorised access to their account.

Data Retention

TourVigator retains Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, including to maintain the Supplier relationship, operate the platform, complete transactions, provide support, prevent fraud, resolve disputes, enforce agreements, maintain business records, and comply with applicable legal, tax, accounting and regulatory obligations.

The specific retention period may vary depending on the type of Personal Data, the purpose for which it was collected, the Supplier relationship, legal requirements and applicable limitation periods.

Where required by applicable law, TourVigator will provide appropriate information and choices regarding non-essential cookies or similar technologies.

The TourVigator platform may integrate with or contain links to third-party services, including payment providers, connectivity partners, identity verification services, communication services and other external platforms.

Third-party services may process Personal Data under their own privacy policies and terms. TourVigator is not responsible for the privacy practices of independent third parties outside its control.

Children's Personal Data

The Supplier Portal is intended for businesses and individuals who are legally able to enter into the Supplier relationship. TourVigator does not knowingly require children to provide Personal Data for the purpose of creating Supplier accounts.
